The film, Dallas Buyers Club, has become the subject of a new wave of file sharing warning letters in Germany. The law firm behind the warning letters is Fareds Rechtsanwaltsgesellschaft mbH. If you have received a file sharing warning letter, here are some tips on what to do.
Dallas Buyers Club – file sharing warning letter
The German law firm, Fareds, is once again active on the file sharing front. The firm has recently sent a wave of warning letters, accusing internet users of infringing German copyright law through the use of file sharing websites.
The subject of the warning letters is the film, Dallas Buyers Club. The copyright holder is the Dallas Buyers Club LLC, 2170 Buckthorne Place Suite 400, the Woodlands, TX, 77380, USA.
The warning letters contain claims for compensation and require recipients to cease and desist the alleged copyright infringement. Fareds states that its client is prepared to drop all claims upon payment of a settlement amount of €1,200.
How to react to the warning letter
Do not feel compelled to accept the claims against you without first having them examined. It is highly advisable to take legal advice, as the required undertaking to cease and desist contains obligations which are binding for many years.
Any assertions made in file sharing warning letters that internet connection owners are liable, under any circumstances, for third party conduct is also not entirely correct. Having the matter checked by a legal professional is therefore worthwhile.
