After registering a trademark, you should ensure that monitoring newly registered trademarks becomes an important part of your trademark strategy.
Around 6,000 trademarks are registered at the German Patent and Trademark Office every month. Although the office maintains a database in which registered and rejected trademarks are contained, the office does not itself assess whether applications containing new trademarks are similar to existing trademarks.
To avoid a newly registered trademark being confused with your own, you should ensure you conduct regular trademark searches and monitor newly registered trademarks. Conducting regular searches means that you can quickly object to applications to register new trademarks and submit an application to have infringing trademarks deleted.
Due to the number of trademarks registered every month, monitoring should be conducted using appropriate software.
